Project Details

Description

This book is based on the general theory of real rights and the relationships between people and things based on the basic concepts of civil law. Goods and their treatment by law is what we address, focusing exclusively on the general framework, with a contemporary approach to the new institutional, legal and principled theory of things. These, today, have much more importance than before. Business marks the day to day. Investments, traffic and commercialization drive the country's economy and the increasingly varied commercial operations enlist real rights as their essential part.
We start by studying the great universe of goods, based on a theoretical and doctrinal approach that seeks to substantiate its nature and characterology. We analyze the theory of real rights, passing through the theory of the object of law, as everything material that implies legal significance and that allows the satisfaction of the needs of the subjects. We present the principles of real rights from a comparative point of view, seeking to establish our own framework, a true scheme of the principles of real rights in Peru, taking into account the norm and reality, jurisprudence and casuistry against the law. In the area of actions, we deal with the diversity of existing judicial mechanisms that preserve real rights; as necessary as they are indispensable, real actions allow the direct defense of rights.
