Abstract
The author reflects on the substantive tools designed to optimize the protection of the rights of the person on a constitutional basis, highlighting the need for less restrictive preventive (declarative and inhibitory) guardianships to coexist in our legal system, together with the classic compensatory guardianship, which cannot be avoided under the criterion that the existing precautionary mechanisms and coercive measures are sufficient.
